Udružena akcija EU građana (bravo svi!) kojom uporno bombardiramo zastupnike EP mejlovima daje rezultate

PREDMET: WE SAY NO TO COERCION_

TEKST MAILA: VOTE ‘NO’ to the Digital CertificateREASON #7 – FUNDAMENTAL RIGHTS ‘SMASHED INTO PIECES’ – Part One

Following the previous reports, here is one more legal and ethical reason why we ask you to VOTE ‘AGAINST’ the Green Digital Certificate:

The Principle of ‘No Coercion’

EU citizens have the right to have their decisions taken responsibly, freely and voluntarily, on any actions affecting their health. They have the right to decide, whether or not to consent to the administration of a medical product, and “shall beforehand be given appropriate information as to the purpose and nature of the intervention as well as on its consequences and risks.” They have the right to make decisions according to their own free will, at any time. (1)

(1) Convention for the Protection of Human Rights and Dignity of the Human Being with regard to the Application of Biology and Medicine: Convention on Human Rights and Biomedicine. Oviedo, 1997 (Article 6)The European Court of Human Rights has emphasized that a person’s bodily integrity concerns the most intimate aspects of one’s private life. (2)

(2) European Court of Human Rights Guide for article 8 – 31 august 2020 https://www.echr.coe.int/Documents/Guide_Art_8_ENG.pdfThe Digital Certificate clearly constrains EU citizens to make certain decisions about their health.T

he Proposal not only underestimates their decision-making capacities and their responsibility for their health, but also sets up a condition on free movement if citizens do not allow intrusions into their body integrity.

As we have put forward in our previous reports, free movement is a fundamental right in the EU. If the Proposal allows free movement only to those who submit to medical interferences, this equals to use the coercive force in a covert and unacceptable way.Indeed, the combined effects of the forced permanent testing and the impossibility to travel in the absence of a health test, strongly pressures the population to accept vaccination as the only sustainable solution to exercise their right to travel. This is therefore de facto, though not de jure coercion to get vaccinated. As we see it, this Proposal of Digital Certificate tears fundamental rights apart from us and imposes a series of constraints i.e., an endless chain of testing or forced vaccination which violate the right to body integrity. This is nothing to do with free will, consent or respect of fundamental rights. As we see it, is coercion.W

e will continue, in the following days, to send you legal and scientific elements justifying and supporting the view that you should VOTE ‘AGAINST’ this unprecedented attack on our fundamental freedoms.Kind regards,
